Sealed bids will be received by the Sioux Empire Red Cross, at 808 North West Ave, Sioux Falls, South Dakota 57104, until 2 p.m., on February 1, 2012. The bids will then be opened and read aloud. An award of the bids may be made at the next regular meeting of the Sioux Empire Red Cross.
This request for bids will cover the purchase of the following:
System Specifications for a 230 Generator with Automatic Transfer Switch and Turn Key Installation Backup Power System for the American Red Cross Building
Bids must be submitted on the prescribed bid form included in the Instruction to Bidders and Bid Specifications. Bid specifications are available and may be obtained at the Sioux Empire Red Cross.
Bids must be accompanied by a bid guaranty either in the form of a certified check, cashier's check, or a bank draft issued upon a national or state bank in the amount equal to 5% of the amount bid and payable to Sioux Empire Red Cross, or a bid bond in the amount of 10%.
By virtue of statutory authority, preference will be given to material, products, and supplies found or procured within the State of South Dakota. A resident bidder is allowed a preference as against the bid of any bidder from any other state enforcing or having a preference.
The Sioux Empire Red Cross reserves the right to waive any irregularities deemed advantageous and to reject any or all bids.

The regular meeting of the Dell Rapids Planning Commission was held at City Council Chamber on Tuesday, October 25, 2011 with the following members present: Chairman Bob Lamberty, Craig Lauritzen, Charlie Pleskac, Roger Dearduff, Darrell Donelan, Rod Pierson, Mike Kroger.
Chairman Bob Lamberty called the meeting to order at 7:00 p.m.
Motion by Dearduff second by Lauritzen to approve the June 28th, County Planning Commission Planning Commission Minutes. Upon voice vote all members present voted aye. Motion carried.
Motion by Lauritzen second by Pleskac to approve the August 22nd, 2011 Joint Minnehaha County and Dell Rapids Planning Commission Minutes. Upon voice vote all members present voted aye. Motion carried.
Plat of Ripple Creek Road Addition: Plat was submitted to the Commission for approval in order to dedicate Tracts 3 and 4 of Ripple Creek Road Addition into one parcel as Public Right of Way. The School and DIG development has completed construction of Ripple Creek Road and now wishes to turn it over to the City. Discussion held on allowing platting of a dead end street. Commissioner Pierson raised concerns that there is no requirement for the developer to connect Ripple Creek Road and 12th Street. Commissioner Pierson recommended requiring developer to plat the connection of these streets. Motion made by Kroger, Second by Dearduff to approve Plat of Ripple Creek Road Addition in the Timber Ridge Addition . Upon voice vote Dearduff, Kroger, Donnelan and Lamberty voted aye - Lauritzen, Pleskac and Pierson voted nay. Motion Carried 4-3.
Motion by Pierson to adjourn. Seconded by Pleskac. Chairman Lamberty declared the meeting adjourned at 7:30 p.m.

NOTICE OF APPLICATION NO. 7278-3 to Appropriate Water
Notice is given that Mooody County Dairy LP, c/o Lynn Boadwine, 3005 E 10th St, Sioux Falls SD 57003 has filed an application for a water permit to impound 19 acre-feet of water from clean water runoff in a storage pond located in the SE 1/4 SE 1/4 Section 10-T104N-R47W- Minnehaha County South Dakota, the S 1/2 of Government Lot 2 of Section 10 and SW 1/4 SW 1/4 of Section 11 all in T104N-R47W - Rock County Minnesota. Water will then be diverted at a rate of 0.16 cubic feet of water per second from a point in the SE 1/4 SE 1/4 Section 10-T104N-R47W- Minnehaha County South Dakota for commercial use for washing needs in a dairy cattle operation.
Pursuant to SDCL 46-2A-2, the Chief Engineer recommends APPROVAL of Application No. 7278-3 because 1) unappropriated water is available, 2) existing rights will not be unlawfully impaired, 3) it is a beneficial use of water, and 4) it is in the public interest. In accordance with SDCL 46-2A-23, the Chief Engineer will act on this application, as recommended, unless a petition is filed opposing the application or the applicant files a petition contesting the Chief Engineer's recommendation. If a petition opposing the application or contesting the recommendation is filed, then a hearing will be scheduled and the Water Management Board will consider this application. Notice of the hearing will be given to the applicant and any person filing a petition.
Any person interested in opposing or supporting this application or recommendation must file a written petition with BOTH the applicant and Chief Engineer. The applicant must file a petition if contesting the Chief Engineer's recommendation. Special Commission Action Requests:
Ken McFarland, Commission Administrative Officer, gave a briefing on the creation of a new position within JDC called the JDAI Juvenile Placement Coordinator. The position would be a lateral move within the JDC utilizing already budgeted funds and personnel. The job description has been reviewed and the position will be placed on the county pay matrix as Grade 17. MOTION by Heiberger, seconded by Beninga, to authorize the creation of the JDAI Juvenile Placement Coordinator position at Grade 17 on the county pay matrix. 5 ayes.

Commissioner Pekas gave a briefing on a correction to Resolution MC11-62 for a compromise of lien for DPNO 32154. The resolution contains an incorrect address as the application listed the home address of the applicant and not the legal address of the property pertaining to the compromise of lien. WHEREAS, a County Aid Lien in the amount of $3,796.55 purports to exist in favor of Minnehaha County and against DPNO 32154 as Lienee, and
WHEREAS, said lienee has filed an application with the County Auditor stating such facts as provided for by Law, NOW, THEREFORE, BE IT RESOLVED that after due consideration of the circumstances the Board of County Commissioners finds it advisable and proper to authorize the Chairman of the County Board and the County Auditor to execute the following:

BOUNDARY CHANGE
Bob Litz, Auditor requested approval of a resolution setting the effective date of a boundary change for the Sioux Falls and Tea Area School Districts. MOTION by Barth, seconded by Heiberger to approve Resolution MC12-02. 5 ayes.
RESOLUTION MC12-02
SCHOOL DISTRICT MINOR BOUNDARY CHANGE
WHEREAS, SDCL § 13-6-85 and § 13-6-86 allow for school district minor boundary changes when all statutory and factual requirements are met; and the Tea Area School District No. 41-5 and the Sioux Falls School District No. 49-5 received a petition for minor boundary change involving the property located in western Sioux Falls, Minnehaha County, South Dakota, originally assigned to the Tea Area School District and seeking to be changed to the Sioux Falls School District; and
WHEREAS, by Action 36198.B11, adopted October 24, 2011, the Sioux Falls School District approved the Petition to Make a Minor Boundary Change to transfer the area to the Sioux Falls School District; and
WHEREAS, by Action #041211, adopted December 12, 2011, the Tea Area School District approved the Petition to Make a Minor Boundary Change to transfer the area to the Sioux Falls School District; and
WHEREAS, pursuant to SDCL § 13-6-86.1 and SDCL § 13-6-87, the county commissions of Minnehaha County and Lincoln County, the counties with property affected by the boundary change, are required to set the effective date of the boundary change for tax allocation purposes, as well as school district voting purposes; now
THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners that the minor boundary change approved by the Sioux Falls School District and the Tea Area School District transferring the property in western Sioux Falls, Minnehaha County, South Dakota, legally described in the Petition of Owners for Minor Boundary Change of School Districts (Exhibit A1) attached hereto, from the Tea Area School District No. 41-4 to the Sioux Falls School District No. 49-5 shall be effective November 1, 2011.

BRIEFING
Brent O'Neil, City of Sioux Falls Economic Development Manager, gave a briefing on the proposed establishment of Tax Increment Finance (TIF) District #14. The proposed district is in the vicinity of 201 East Eighth Street and includes a portion of the River Ramp parking facility, the public parking surface lot, and a portion of the former Schoeneman's lumberyard. The district is being created to prepare the site for development and to stimulate new development in that area, including a riverfront hotel. Commissioner Beninga asked what the dollar value is for all the TIF Districts in the City of Sioux Falls. Mr. O'Neil said he would provide that information to Ken McFarland in the Commission Office.
LEGISLATIVE BRIEFING
Robert Wilson, Assistant Commission Administrative Officer, gave a briefing on pending legislation with a potential impact on county government. Bob Litz, Auditor, spoke on Senate Bill 58 concerning elections conducted at voting centers. Bob O'Connell, Public Affairs & Communications Director for the Sioux Falls Chamber of Commerce, stated they intend to testify at the public hearing for Senate Bill 52 concerning collection of the prepaid wireless 911 emergency surcharge.
