DELL RAPIDS CITY COUNCIL MINUTES Tuesday, January 3, 2012 at 7:30 p.m. Mayor Fiegen called the Dell Rapids City Council regular meeting to order at 7:30 p.m. at the Council Chambers in City Hall. The Pledge of Allegiance was recited and roll was taken finding the following Council Members present: Vice-President Keith DeLange, Mark Downs (arrived at 7:35), Craig Lauritzen, John Paul, David Sommerfeld (via Skype), Carrie Testerman, President Todd Wiebenga and Mayor Scott Fiegen. Absent: Doug Grovenburg. Staff Present: City Administrator, Justin Weiland, Finance Officer, LeAnn Kerzman and City Attorney, Dean Hammer. Approval of Agenda: Testerman moved and Lauritzen seconded the approval of the agenda. Motion carried unanimously. Resolution #2012-01 Transit Rates: Weiland reported to the council that due to cuts to the funding of the transit system at the federal level, it is necessary to consider a rate increase. After discussion on the services provided, Testerman moved and Wiebenga seconded to approve a rate increase of $6 for a Sioux Falls trip and $2 for each in town use. Motion carried unanimously. RESOLUTION #2012-01 Establishing Dell Rapids Transit System Rates WHEREAS, the City of Dell Rapids City Council has Transit System that is owned and operated by the City of Dell Rapids and managed by Inter-lakes Community Action Partnership (ICAP), and; WHEREAS, the Transit System is available for Dell Rapids citizens of all ages; NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Dell Rapids that the Transit rates for in town and Sioux Falls related trips will be as follows and will continue until such time as changes are warranted: (1) $2.00 per in town trips (2) $6.00 per Sioux Falls trips (3) Senior Citizens Free ($1.75 donation appreciated) Dated at Dell Rapids, South Dakota this 3rd day of January, 2012. Discussion ensued. Downs moved and Testerman seconded to approve. Motion carried unanimously. RESOLUTION #2012-2 A RESOLUTION AUTHORIZING A PROCESSING FEE FOR CREDIT CARD, DEBIT CARD OR ELECTRONIC TRANSACTION PAYMENTS WHEREAS, SDCL 4-3-28 allows local governments, by resolutions, to establish and collect a processing fee associated with a credit card, debit card, or electronic transaction. NOW THEREFORE, BE IT RESOLVED BY THE CITY OF DELL RAPIDS, SD: That the City of Dell Rapids Finance Officer is hereby authorized, in his or her discretion, to accept a credit card, a debit card or an electronic payment as payment for a transaction. Fiegen reminded the council they had acted last year to set the cost of living at 2%. Wiebenga added that merit would be determined upon review with a roll rate of 0 to 4%. Fiegen asked that Policy and Procedures members meet to review the pay plan. Lauritzen moved and DeLange seconded to approve the resolution with a 2% cost of living increase for employees and 0% for council and board members. Motion carried six (6) to one (1) with Sommerfeld voting nay. RESOLUTION #2012-03 2012 PAYROLL RESOLUTION WHEREAS, effective and responsive delivery of City goods and services is dependent upon the employment of a highly competent and motivated workforce; and WHEREAS, the City of Dell Rapids wishes to increase base wages for employees by giving a 2% cost of living adjustment to the wage scale for benefitted and part time employees and 0% for the City Council and Planning Commission. NOW, THEREFORE, BE IT RESOLVED, that the Governing Body of the City of Dell Rapids hereby approves and adopts the following wage rates to be disbursed in the calendar year 2012. PROVIDED, HOWEVER, the City may make wage increases for the completion of education requirements, for passing certification tests, for fulfillment of job requirements set at the date of employment, or for meritorious achievement. Executive session was not utilized. Trash Haulers License Renewal Applications: Three applications have been received from the following haulers: A-Ok Sanitary, Hoffman Sanitation and Novak. City staff will see to the continued licensing of any haulers still operating within city limits. Lauritzen moved and Paul seconded to approve the three applications provided they have completed all of their requirements for the license. Motion carried unanimously. Visitors to be heard: None. City Administrators Report: Justin Weiland reported on the following: • State Water Meeting for the consideration for the application for the radio read water meters will be this Thursday, January 5. To save the cost and time of a trip to Pierre, Weiland will be using the University Center in Sioux Falls to attend via video conference. • Dells Bowl did receive their liquor license after application was submitted to the state to review. • Joint meeting with Minnehaha County to be held on Tuesday, January 10, 2012 to discuss height restrictions within the joint jurisdictional area. • Personnel - evaluations were conducted for two employees and merit raises were recommended between 2-3% for each. Treasurers Report - A recap of all income and expenses, since the last meeting, were presented to the council for their review. THE MINNEHAHA COUNTY COMMISSION CONVENED AT 9:00 A.M., January 3, 2012 pursuant to adjournment on December 27, 2011. Commissioners present were: Barth, Kelly, Pekas, Heiberger, and Beninga. Also present were Cindy Jepsen, Commission Recorder, and Gordy Swanson Chief Civil Deputy State's Attorney. Robert Litz, Auditor, opened the meeting and called for nominations for Commission Chairman. MOTION by Barth, seconded by Pekas to nominate Commissioner Kelly as Commission Chairman for 2012. 3 ayes. Heiberger and Pekas voted nay. Motion carries. Mr. Litz relinquished the gavel to Chairman Kelly. Chairman Kelly called for nominations for Commission Vice-Chairman. MOTION by Barth, seconded by Heiberger to nominate Commissioner Beninga as Commission Vice-Chairman for 2012. 4 ayes. Commissioner Beninga abstained. DESIGNATION OF OFFICIAL NEWSPAPERS Ken McFarland, Commission Administrative Officer, reported that proposals were received from the Argus Leader Media and Anderson Publications for designation as official county newspapers. Kelly Redfearn, Advertising Director for the Argus Leader, was present to request designation of the Argus Leader, Dell Rapids Tribune, and the Brandon Valley Challenger as the official county newspapers. Both proposals reflected no increases in rates. Anderson Publications proposal requested designation of the Hartford Area News as one of the official newspapers. MOTION by Heiberger, seconded by Pekas to designate the Argus Leader, Dell Rapids Tribune, and the Hartford Area News as the official Minnehaha County newspapers for 2012. 5 ayes. Barth voted nay. ELECTION PAY Robert Liz, Auditor, presented a resolution to set the pay schedule for election workers for 2012. The resolution would keep the same rates as in 2010 & 2011. OPPORTUNITY FOR PUBLIC COMMENT Bob Kolbe addressed the commission regarding funding for the volunteer ambulance and fire departments. Mr. Kolbe suggested the state legislature consider using gas tax money to supplement these departments for the services they provide in response to accidents on state and federal highways. Ken McFarland explained the rural fire departments in Minnehaha County are funded by a rural fire levy. The ambulance services in Minnehaha County are currently funded by a general fund allocation. Other possible sources of funding would be to create an ambulance district or implementation of a county wide ambulance levy. APPOINTMENT Scott Anderson, Planning Director, reported that Don South's term as a Planning Commissioner has expired and he is not seeking re-appointment. Two applications to fill the vacant seat have been received from Chris King and Bonnie Duffy. MOTION by Barth, seconded by Pekas to appoint Bonnie Duffy to the Planning Commission. 5 ayes. SURPLUS PROPERTY Ken McFarland, Commission Administrative Officer, gave a briefing on a request from the Extension Office to donate items they will no longer be using after they move to the new Regional Extension Center. The Auditor's office has confirmed that none of the items appear on the county's capital asset list due to the dollar value of the items. MOTION by Barth, seconded by Beninga, to declare the Extension items surplus for the purposes of donation to the Master Gardener Program, the specialist at the Regional Extension Center, and the Sioux Empire Fair Association. 5 ayes. AGREEMENTS Ken McFarland, Commission Administrative Officer, requested authorization for the Chairman to sign the Lutheran Social Services (LSS) Middle School Diversion Officer Agreement. Under the terms of the agreement, LSS will provide staffing, program supplies and materials for the Middle School Diversion Officer not to exceed the grant allocation of $35,556 from the Juvenile Accountability Block Grant Program, which funds the position. MOTION by Heiberger, seconded by Beninga to authorize Chairman to sign the Agreement For Pass Through Grant For School Resource Officer with Lutheran Social Services. 5 ayes. Ken McFarland, Commission Administrative Officer, reported on the approval of a $100,000 grant proposal submitted to the SD Council of Juvenile Services. The grant funds are to be used to implement a reception center and an evening report center operated by Volunteers of America as part of the 2012 Juvenile Detention Alternative Initiative (JDAI) work plan. MOTION by Barth, seconded by Heiberger to authorize the Chairman to sign Notice of Award and Special Conditions, Assurances, and Certifications for the $100,000 Grant Award from the Council of Juvenile Services for the JDAI. 5 ayes. Ken McFarland, Commission Administrative Officer, presented a renewal agreement with Communication Services for the Deaf, now known as CSD of South Dakota, to provide interpreter services to county departments and the courts. The agreement will run from 1/1/12 to 12/31/13. The hourly rates for all services outlined in the contract remain the same as the last two years. MOTION by Pekas, seconded by Barth to authorize the Chairman to sign the two year, Professional Service Agreement with CSD of South Dakota. 5 ayes. Ken McFarland, Commission Administrative Officer, gave a briefing on a contract renewal with Correct Care Solution (CCS) to operate the Minnehaha County Detoxification Center. Based on actual expenses and anticipated quarterly adjustments, the contract sum for 2012 will be in the amount of $696,284. The renewal agreement extends the current contract with CCS through December 31, 2013. MOTION by Pekas, seconded by Barth, to authorize the Chairman to sign the Detoxification Facility Operation Agreement between Correct Care Solutions, LLC and Minnehaha County. 5 ayes. Darin Young, Warden, presented an agreement with Correct Care Solutions, LLC for inmate medical care. The current contract which will expire on December 31, 2011, grants the county two (2) one-year renewal options. The 2012 contract sum is in the amount of $1,344,934. The service agreement recognizes quarterly adjustments may be needed to reflect actual costs. MOTION by Pekas, seconded by Barth to authorize the Chairman to sign the Health Care Services Agreement between Correct Care Solutions, LLC and Minnehaha County effective January 1, 2012 through December 31, 2013. 5 ayes. SD DEPARTMENT OF LABOR RULING Ken McFarland, Commission Administrative Officer, gave a briefing on the SD Department of Labor ruling on a grievance filed by the Minnehaha County Deputies Association on the salary roll back that was adopted by the County Commission as part of the final 2012 budget for all county employees. The ruling stated that Minnehaha County violated the collective bargaining agreement by imposing the 5% salary roll back on the members of the association. The roll back is scheduled to go into effect for the payroll period beginning December 24, 2011 and ending January 6, 2012. Mr. McFarland presented a spreadsheet showing the impact of the 5% wage roll back for each department. The impact of the wage roll back for law enforcement employees is $491,529, for Highway union employees $51,529, and for other employees of the county $808,709. Mr. McFarland also reported on potential unbudgeted revenue sources that could impact the 2012 budget. $225,000 could be realized from five positions budgeted for in 2012, but not yet filled; $200,000 in savings from lower that budgeted inmate medical services; $200,000 in potential revenue from the sale of surplus highway equipment; and potentially higher than budgeted Bank Franchise Tax revenue. Doug Huffer, Highway Department employee and President of the local 2561 Highway labor union, spoke on the adoption of the county pay plan in 2008 that allows for increases and no decreases in employee pay and given the recent grievance and findings of the Deputies dispute, there appears to be two pay plans now. Mr. Huffer stated the highway department is separately funded and has no impact on the general fund. He asked the Commission to consider all county departments when discussing the SD Department of Labor ruling on the Deputies Association grievance. Gordy Swanson, Chief Civil Deputy States Attorney, stated it will take a couple weeks before the judge's ruling is final, after which the commission will have 30 days to appeal that decision to circuit court. MOTION by Barth to restore the 5% roll back to the entire county work force. Motion dies for lack of second. MOTION by Pekas, seconded by Beninga, to delay the roll back for the Deputies Association until the final findings and conclusions are received from the SD Department of Labor ruling. 4 ayes. Kelly voted nay. Motion carries. Ken McFarland indicated the commission will need to determine by the end of the month how the delay in the 5% roll back for the Deputies Association will be funded. Chairman Kelly passed the gavel to Vice Chairman Beninga for the purpose of making a motion. MOTION by Kelly, seconded by Barth to delay implementation of the 5% roll back for all employees, except Commissioners, until February 1st. 2 ayes. Pekas, Heiberger, and Beninga voted nay.
