FACT OF ADOPTION
An ordinance amending Ordinance MC16-90 the 1990 Revised Zoning Ordinance for Minnehaha County.
The Minnehaha County Board of Commissioners adopted Ordinance MC16-105-09 on June 16, 2009. This ordinance amended Ordinance MC16-90 the 1990 Revised Zoning Ordinance for Minnehaha County by adding a new section in Article 12.00 entitled Agricultural Tourism and adding supporting text to the A-1, RC, and definitions articles of the ordinance.
The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours.

The Minnehaha County Board of Commissioners adopted Ordinance MC20-05-09 on June 16, 2009. This ordinance amended Ordinance MC20-92, the On-Site Wastewater Treatment Treatment Ordinance by
Amending the permit fee portion of Section 2.01. to read as follows:
Routine maintenance and repai $75.00; Installation of a holding tank only $100.00; Extension of existing drainfield $150.00; New or replacement system $150.00; Engineered system $175.00
And Amending Section 7.02 to read as follows:
Section 7.02. Rapidly Permeable Soils: For soils with a percolation rate faster than 6 minutes per inch, a soil absorption system may be used only if a soil liner system (Figure 7-1) is constructed to place a minimum of 12 inches of a soil having a percolation rate between 16 and 24 minutes per inch between the bottom of the rock layer and the high percolation rate soil. The system shall be sized using the soil sizing factor for sandy loam soil 1.67 square feet per gallon per day.

HEARING
Kristin Trana, Sheriff's Office Administrative Coordinator, was present for the scheduled hearing to consider a joint spending plan for the 2009 Edward Bryne Justice Assistance Grant. The previous spending plan approved on 4/28/09 and was part of an economic stimulus plan. Today's plan is for the routine allocation totaling $165,700 to be split between Minnehaha County ($57,995) and the City of Sioux Falls ($107,705). The proposed County spending plan includes purchasing protective vests ($25,000), SWAT team equipment ($5,000), State's Attorney training/travel ($7,000), School Resource Officer training/ travel/supplies ($5,000), and law enforcement training/travel ($8,995). The City's proposed spending plan includes the purchase of police rifles and software maintenance fees. No one spoke in opposition. MOTION by Barth, seconded by Hajek to approve the Minnehaha County/City of Sioux Falls Joint Spending Plan for the 2009 Edward Byrne Justice Assistance Grant. 5 ayes.
HIGHWAY
At the request of Bob Meister, Highway Superintendent, MOTION by Barth, seconded by Hajek to authorize the purchase of a Smithco Model S3 side dump trailer off of a bid awarded by the City of Huron to Siouxland Trailer Sales of Harrisburg, SD in the amount of $41,600.00. 5 ayes.
SPONSORSHIP
Travis and Edith Arneson with the Sioux Falls Jaycees were present to request a sponsorship of the annual 4th of July celebration at the W.H. Lyon Fairgrounds. Mr. Arneson reported that this has been a free event for families for the past 5 years. The Sioux Empire Fair Association has sponsored the event for those years and continues to do so to some extent. The Jaycees have raised $4,080 for the event with $12,530 to go. While commissioners supported the event, they also recognized the difficulty in finding funds. Commissioner Barth felt the media attention would give the Jaycees an opportunity to find public sponsors. The Jaycees indicated that funds normally used to support other community events could be used to pay for the fireworks display, but they would prefer to preserve those events. No action was taken.
HEARING
Phil Kappen, Assistant Planning Director, was present for the scheduled hearing to consider an amendment to the 1990 Revised Zoning Ordinance for Minnehaha County by adding a subsection to allow agriculturally related uses in the RC Recreation-Conservation zoning district as a conditional use. The provision is available in the A-1 Agricultural District and staff supports making it available on a case-by-case basis in the RC District. Mr. Kappen reported that the amendment was previously approved in February 2009, but had to be re-heard because it was discovered that the Planning Commission Hearing notice was not properly published. No one spoke in opposition. MOTION by Kelly, seconded by Hajek to approve Ordinance MC16-106-09. 5 ayes. The entire ordinance is on file in the Auditor's office.
APPEAL
Phil Kappen, Assistant Planning Director, was present for an appeal of a Planning Commission (PC) decision to deny a Conditional Use Permit for a private campground on property legally described as the S1/2 NE1/4 (Ex RY) & N1/2 SE1/4 (Ex ROW) & Tract 2 (Ex Lot 1) and Lot 1 Tract 1 in SE1/4 all in Section 2-T102N-R48W. Mr. Kappen reported that Marvin Manifold applied for a conditional use permit to operate a private 12-unit campground on property he owns. A private campground is listed as a conditional use in the A-1 Agricultural District in the 1990 Revised Zoning Ordinance for Minnehaha County. After several deferrals, the PC denied the request because a revised site plan moving the driveway was not submitted and due to concerns expressed by neighbors. Staff provided 18 conditions that are recommended if the permit is approved. The conditions were slightly different that those reviewed by the PC. Initially a state permit requirement was included, but later removed. The state permit would outline conditions if the site were to go public. Scott Anderson, Planning Director, reported that a revised plan was submitted this morning and the driveway was moved further west, away from a nearby residence. The PC did not see the revised site plan or conditions. Commissioner Hajek expressed concerns that the campground would become a public use facility. Commissioner Kelly reported that the main issue for denial was the driveway location. Commissioner Twedt noted that on many occasions, changes are made to requests coming before the Commission after being heard by the PC. She also noted that staff will be burdened with the responsibility of monitoring the conditions, adding to staffing costs. Sam Assam was present on behalf of the Manifold family. He explained that a condition on ownership of the property was not included in those presented today and did not oppose placing it back on the permit. He stated that the only intent of the campground is for private family use by the Manifolds. Dan Irvine, area resident, reported that his property abuts the Manifold property on the northeast near the campground. He expressed concerns about pets running at large as he runs livestock on his property and has lost sheep to dogs in the past. He also had concerns over campfires, other fire hazards, and unsupervised camping and explained that he has had problems with trespassers entering his property from the Manifold land. He asked who would be liable for any damage to neighboring properties and wanted a contact number that would be answered if any problems arose. Steve Farley, area resident, was opposed to the access road going around his property. He reported that the driveway was moved across from another neighboring property, and that that neighbor would like to see it moved even further west. Mr. Assam again explained that the Manifolds are good neighbors, do not wish to have a public campground, and that they wouldn't risk having their permit revoked after spending money to improve the site. MOTION by Kelly, seconded by Barth to add 2 additional conditions: a) the conditional use permit shall apply only to the petitioner Marvin Manifold. Upon any change in ownership of the property the conditional use permit shall become void; and b) a management list with contact phone numbers shall be provided to the Planning Department and abutting landowners. MOTION by amend by Hajek to add 24-hour contact phone numbers to the conditions. Motion dies for lack of a second. VOTE on the main motion. 5 ayes. Commissioner Pekas expressed concerns on why the applicant would opt for a restricted plan when he and his family can camp on their land without a permit. Mr. Anderson explained that the current use of the land for camping is not a permitted use because there is no residence there, the land use is agricultural. When extended family come to stay, the use is more extensive. Staff explained that a 14 day condition was placed to eliminate someone living there. MOTION by Barth, seconded by Kelly to refer consideration back to the Planning Commission. 3 ayes, Hajek and Twedt - nay.
NEW BUSINESS
Commissioners discussed an opportunity to borrow funds through federal recovery zone bonds. The funds will be borrowed at a subsidized interest rate. Sue Roust, Auditor, reported that the funds are available until 12/31/2010 and that the borrower needs to apply for the subsidy on a semi-annual basis with no guarantee of continued funding. A smaller than estimated savings could be realized because the bonds are taxable. Commissioners will continue looking at building projects and funds and will continue monitoring building needs.

MINUTES OF 24 June 2009 SPECIAL SESSION
THE BALTIC CITY COUNCIL MET IN SPECIAL SESSION ON 24 JUNE 2009. Mayor Michael Wendland was absent. Council President Jason Pittmann called the meeting to order at 2:30 PM. Present by telephone were Council members Calvin Whiting, and Ron Jenks. Jason Turner was not available by phone and was not present at City Hall. Also present was Finance Officer Hendrickson. This was a telephonic meeting with a speaker phone available in City Hall. The meeting was held at the Baltic City Hall.
The purpose of this meeting was to hear applications for 2 (two) temporary malt beverage licenses. One license for Baltic Lounge to sell malt beverages in RiverPark on June 26th and 27th and 28th during the mid-season ball tournament. One license for Baltic Lounge to sell malt beverages in New Baltic Heights Park on June 26th and 27th and 28th during the mid-season ball tournament. Whiting made a motion to approve both licenses under the same motion. Motion seconded. All present voted Aye. Motion carried.
At 2:35 PM Whiting made a motion to adjourn. Motion seconded. All present voted Aye. Motion passed.
