INVITATION TO BID
Sealed bids for the Dell Rapids High School Toilet Room Remodel, Dell Rapids, South Dakota will be received by Dell Rapids School District 49-3, 1216 N. Garfield Avenue, Dell Rapids, South Dakota until 2:30 p.m. CDT on Thursday, April 23, 2009 at which time bids will be opened and read aloud in the Middle School Commons. Bids will be presented to the Board of Education for their review at their next regularly scheduled meeting following the bid opening.
Bids will be received in accordance with the Construction Documents prepared by Architecture Incorporated, dated March 31, 2009. Plans and Specifications will be made available and may be examined at the office of the architect, Architecture Incorporated, 335 North Main Avenue, Sioux Falls, South Dakota. Each bidder and major subcontractors will be issued one complete set of documents for a deposit of $75.00, which will be refunded upon returning such set in good unmarked condition within 10 days of the bid opening.
All bids and contracts shall be made in accordance with and subject to SDCL 5-18, 5-19, 5-20, 5-21, 5-22 and the provisions set forth in the specifications.
Bids shall be submitted on the Bid Proposal Form provided with the Construction Documents in a sealed envelope addressed to Dell Rapids School District 49-3, 1216 N. Garfield Avenue, Dell Rapids, SD 57022. Bid envelopes shall be clearly marked on the outside lower left corner “Bid – Restroom Renovation.” Full responsibility of the delivery of mailed bids prior to the deadline for receiving bids rests with the bidder.
Each bidder must deposit bid security with the bid. Such security shall be based upon the amount of the base bid, including add alternates, and shall consist of a Bid Bond for ten percent (10%) of the amount or a certified check, cashiers check or draft in the amount of five percent (5%) of the base bid and drawn on a State or National Bank. Such Bid Bond shall be issued by a surety authorized to do business in the state of South Dakota and payable to the Dell Rapids School District. The Bid Bond shall guarantee the execution of the contract by the successful bidder and shall be held by the Dell Rapids School District until said contract is executed.
No bidder may withdraw a bid for 30 days following the bid opening without a written request explaining the cause of the withdrawal and without written consent of the School District after reviewing the cause.
The successful bidder shall furnish bonds covering faithful performance of the Contract and payment of obligations arising there under. The amount of each bond shall be equal to one hundred percent (100%) of the Contract Sum, plus all approved alternates, as originally bid or subsequently modified.
The School Board reserves the right to reject any and all bids or parts thereof, and to waive any irregularities of any bid. The School Board also reserves the right to award the Contract to the lowest responsible bidder as may be determined by the School Board.

LIEN
Commissioner Barth, County Aid Lien Liaison, briefed the Commission on a request to compromise DPNO 68803, in the amount of $96.00 for Public Defender services, in full with no payment. The applicant does not feel she should be responsible for the amount and claimed on her application that she only had phone contact with the Public Defender and decided to pay her ticket rather than contest it after that conversation. The Public Defender did verify the information and noted that there was an error in the billing, reducing the lien amount to $56.00. MOTION by Barth, seconded by Kelly to reduce the lien to $56.00. Commissioner Twedt did not support the motion and noted that it did not appear, based on information from the applicant, that application for a Public Defender was made. Commissioner Kelly withdrew his second. A second was made by Commissioner Hajek. Sue Roust, County Auditor, stated that the billing error would be corrected administratively and that anything less than the actual balance of $56.00 would require commission action. Commissioner Hajek noted that the lienee was charged with a traffic violation, asked for an attorney, received legal advice, and now is asking to not pay the bill. Gordy Swanson, Deputy State's Attorney, stated that judges do not appoint a Public Defender unless application is made. Commissioner Twedt noted the applicant's age and fact that there had been a billing error. SUBSTITUTE MOTION by Kelly, seconded by Twedt to compromise the lien with no payment. 2 ayes. BRIEFING
Ron Wieman, Fair Board Chairman, thanked the Commission, Fair Board Members, Fairgrounds staff, and the community for their continued support. He introduced interim CXO, Tryg Fredrickson. Dr. Fredrickson reported on changes implemented since taking office which include expanding the role of the contract accountant, investigative accounts payable, inventory control, cash management procedures, management oversight, and redeveloping roles and responsibilities. He explained that the forensic audit of the Sioux Empire Fair Association accelerated findings that would have likely been revealed during the annual year-end financial audit and that the fair event itself is financially successful with a solid accounting process. Commissioners asked that previously requested information on costs and revenues from ongoing activities on a month-to-month basis at the Fairgrounds be provided prior to contract negotiation discussion. They discussed long range planning, master plan, and improvements to the site that were recommended in previous years. Mr. Wieman asked that contract re-negotiations begin soon in order for the Association to plan for future events. Dave Renli, Executive Director, Sioux Empire Safety Village, stated that his organization rents space on the fairgrounds for the Safety Village. He has proposed a long term land use lease and asked about the progress of working with the fairgrounds heirs in modifying some of the terms of the land use agreement in order to offer long term opportunities to users. Mr. Wieman reported that the Board has been meeting with Dean Axtell, heir, which has been positive. Commissioners supported a community task force to discuss questions on how to move forward, but noted that there would not be enough time to accomplish any goals before the contract renewal date.
HIGHWAY
County Highway Superintendent Bob Meister presented three resolutions for highway projects as part of the Federal Aid Surface Transportation Program. Total cost for the projects is estimated at $2.23 million which will be funded with STP allocations. MOTION by Barth, seconded by Twedt to approve Resolutions MC09-10, MC09-11, and MC09-12. 5 ayes.

AGREEMENT
Hugh Grogan, Human Services Director, presented the annual agreement for caseworker services with Lincoln County. He reported that this year's contract rate decreased from $58,323 to $55,920. The decrease is due to the caseworker's non-participation in the group insurance plan. Gordy Swanson, Deputy State's Attorney, noted that it was not customary to base a contract price on one individual. Commissioner Twedt noted that it was the County's intent to continue this partnership. Commissioner Kelly stated it was unfair to bring in the agreement the day before contract renewal. MOTION by Kelly, seconded by Twedt to authorize the Chairman to sign the agreement. 1 aye, Barth, Hajek, Pekas, and Twedt - nay. Motion fails. Mr. Grogan stressed the importance of basing the contract on the actual cost. Sue Roust, County Auditor, reported that a weighted average, with both insured/uninsured staff costs, is used when calculating jail bed rates. MOTION by Hajek, seconded by Barth to add language provided by Gordy Swanson, Deputy State's Attorney, adding a pro rata value and bringing the contract back for approval. SUBSTITUTE MOTION by Kelly, seconded by Twedt to defer consideration of the agreement for 2 weeks. 3 ayes, Hajek and Pekas - nay.

Lynn DeYoung, Emergency Management Director, reported that bids were opened on March 18th for various sized towable generators as part of a regional purchase under the Homeland Security Grant Program. At the request of Deputy Sheriff Lieutenant Vicki Hicks, MOTION by Barth, seconded by Twedt to supplement $123,969.03 from the General Fund to the Sheriff's budget (ASN 16678) representing unspent 2006-2008 State Criminal Alien Assistance Program funds. 5 ayes.
NEW BUSINESS
At the request of Commissioner Twedt, Eli Whitney, Director of Equalization, addressed a request for a full assessment of all properties in Hartford from the Hartford City Finance Officer. Mr. Whitney reported that his office responded to a similar request from the city of Hartford, to look at basement finish in 2007, and that those assessments have been in place for 2 years. He announced that his staff plans to review all properties in the cities of Hartford and Dell Rapids over the summer.
Commissioner Pekas commented on a recent article in the Argus Leader on Minnehaha County's position on the sale of tax certificates. He believed that it was the County's responsibility to take in the taxes, that other entities also rely on, and supported selling the certificates to bring that money in. He explained the tax certificate process. Commissioner Twedt noted that the County budget is based on 5% uncollectible property taxes, while the County typically has less than a 2% delinquency rate. Sue Roust, County Auditor, added that interest accrues monthly on delinquent properties and that the state dictates how the County can collect taxes. She also reported that the decision on whether to sell tax certificates is up to county commissions and that Minnehaha County has chosen by policy not to sell those certificates.
